Here in Western Australia, the WA Health government web page has a great deal of information on this subject. It’s illegal in WA to smoke in your car if there is a child under the age of 17 with you. Failure to adhere to this law can lead to a $200 fine, and if the case goes to court, this could rise to a $1000 fine.
The South Australia public health body is SA Health, and like WA Health they have made a lot of information available to peruse online. In SA it’s illegal to smoke in a car with any passenger that is under the age of 16. It’s also important to realise that SA Health makes it quite clear that this legislation affects anyone in the vehicle and not just drivers. This is also illegal whether the car is parked or in motion at the time of the offence.
The Northern Territory
The NT government webpage on this subject is quite specific on the how smoking in a car with minors is treated. Because the prevailing research has shown that exposure to secondhand smoke in a confined space is unhealthy, Police have powers to deal with smoking drivers that have minors in the car. If you’re spotted smoking with a child under the age of 16 present, you can be issued with an on the spot fine or a penalty.
